1. Acceptance of Terms

By accessing, browsing, or using the website www.pvm-invest.com (the “Site”), operated by Paul van Melis trading as PVM Invest, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”), our Privacy Policy, and any additional terms referenced herein.

If you do not agree with any part of these Terms, you must immediately discontinue use of the Site.

These Terms constitute a legally binding agreement between User and Paul van Melis / PVM Invest.

  • New development promotions and off-plan property sales
  • Property investment advisory and market analysis
  • Legal and administrative support for property transactions (in collaboration with licensed professionals)

Important: The content on this Site is for informational purposes only and does not constitute legal, tax, or financial advice. All property transactions in Spain must be formalized before a Spanish Notary and registered in the Land Registry to be legally effective.


3. Eligibility

By using this Site, you represent and warrant that:

  • You are at least 18 years of age and have full legal capacity to enter into contracts under Spanish law.
  • You are not prohibited from accessing this Site under applicable laws (including international sanctions).
  • If accessing on behalf of a company or entity, you have authority to bind that entity to these Terms.

6. Property Listings and Information Accuracy

  • Property details (price, size, features, availability, photos, plans) are provided by sellers, developers, or public sources and are believed to be accurate at the time of publication. However, we do not guarantee completeness, accuracy, or currency of any listing.
  • Prices are indicative and subject to change without notice. Final prices, taxes (IVA/ITP, AJD), notary, registry, and legal fees must be confirmed in writing prior to signing any contract.
  • Floor plans, renderings, and virtual tours are illustrative and may not reflect exact finishes or dimensions.
  • We encourage all Users to conduct independent due diligence, including physical viewings, verification of titles, licenses, and community fees, and consultation with independent legal and tax advisors.

No agency relationship is created merely by browsing the Site or making an inquiry. A formal agency agreement must be signed in writing to establish representation.


7. Limitation of Liability

A. General Disclaimer

THE SITE AND ALL CONTENT, SERVICES, AND PROPERTY INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

B. Exclusion of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING SPANISH CONSUMER LAW AND CIVIL CODE), PVM INVEST, PAUL VAN MELIS, AND OUR AFFILIATES SHALL NOT BE LIABLE FOR:

  • ERRORS, OMISSIONS, OR INACCURACIES IN PROPERTY LISTINGS OR MARKET DATA.
  • DELAYS, INTERRUPTIONS, OR FAILURES OF THE SITE DUE TO TECHNICAL ISSUES, FORCE MAJEURE, OR THIRD-PARTY ACTIONS.
  • ANY DECISIONS OR TRANSACTIONS ENTERED INTO BASED ON INFORMATION FROM THIS SITE.

C. Cap on Liability

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT OF €100 (ONE HUNDRED EUROS).

Note: Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability shall be limited to the fullest extent permitted by law.

13. Dispute Resolution

Before initiating formal legal proceedings, the parties agree to attempt to resolve disputes amicably through good-faith negotiations. If unresolved within 30 days, either party may propose mediation through the Spanish Arbitration Court for Consumer Affairs (Junta Arbitral de Consumo) or a mutually agreed mediator.

This clause does not prevent you from exercising your right to lodge a complaint with the Agencia Española de Protección de Datos (for data issues) or the Consumer Protection Authorities (for consumer matters).


14. Modifications to Terms

We may revise these Terms at any time by updating this page. The “Last Updated” date will reflect changes.

  • Continued use of the Site after modifications constitutes acceptance of the new Terms.
  • For material changes affecting your rights, we will provide reasonable notice via email or a prominent Site notice.

15. Severability and Waiver
